SO ORDERED DISCONTINUANCE OF NEW YORK COUNTY ACTION

In September 2026, Kevin Natale obtained a so ordered discontinuance with prejudice of an action against our client, an ambulatory surgery center. The action involved allegations of negligence relative to development of post-operative infection following open reduction and internal fixation of ankle fractures, resulting in a need for IV antibiotic therapy, wound care, debridement, surgical removal of hardware, and other associated injuries. The discontinuance was obtained after preparation of a motion for summary judgment establishing that the treatment was managed by a co-defendant private attending orthopedic surgeon and that there was no basis for independent liability against the facility regarding claims of unsterile operative conditions and post-operative monitoring by the staff of the facility.
