SUMMARY JUDGMENT FOR PROSTHODONTIST

Summary Judgment was awarded to Kenneth W. Loock in a case alleging a failure to properly perform dental restorations in a timely manner, a failure to advise plaintiff of the risks of the procedures performed, and a failure to advise of any alternative treatments. 

Ken’s expert successfully argued that the treatment provided was done appropriately and timely and further, that an appropriate informed consent was obtained.

Notwithstanding plaintiff’s counsel’s submission of an expert affidavit in opposition, the court determined that there was a failure to raise a triable issue of fact as to causation and said expert offered only speculative and conclusory findings.  As such, summary judgment was awarded in favor of our client.
