DEFENSE VERDICT FOR BOARD CERTIFIED PLASTIC SURGEON
In May, 2026, Thomas Benvenuto, Loretta Palmero and Meghan Cogan obtained a unanimous defense verdict in New York County on behalf of our client, a board-certified plastic surgeon, in a medical malpractice action arising from an elective blepharoplasty procedure. The 42-year-old plaintiff alleged that she suffered complications including ptosis, dry eye, and injury to the levator muscle following surgery. The evidence demonstrated that the plaintiff experienced a known and disclosed complication of the procedure and subsequently chose to discontinue care with our client. She later underwent additional surgery with another provider but remained dissatisfied with her aesthetic outcome. After a full trial and in under one hour, the jury unanimously rejected all claims against our client, finding no departure from accepted standards of care and no causal link between the procedure and the alleged injuries.
